Terms of Service

1. Acceptance

By accessing or using Gabos AI ("the Platform"), you agree to these Terms of Service. If you don't agree, don't use the Platform. These terms apply to all users, including visitors, registered users, and app developers.

2. What Gabos AI Is

Gabos AI is a marketplace for discovering and sharing AI-powered tools and applications ("apps"). We allow developers to submit their AI apps for listing, and users to find and access those apps. We do not build or own the third-party apps listed — developers are solely responsible for their apps.

3. Accounts

You must provide a valid email address and keep your password secure. You're responsible for all activity under your account. Notify us immediately at support@gabosai.com if you suspect unauthorized access.

You may not create accounts to impersonate others, circumvent bans, or automate account creation.

4. App Submissions (Developers)

Developers may submit AI apps for a one-time listing fee. By submitting:

• You confirm you own or have rights to the app and all content in your listing
• You agree your app will undergo a safety review before being approved
• You agree not to submit apps that are malicious, contain malware, violate laws, infringe intellectual property, or are designed to harm users
• You agree apps must remain functional at the URL provided — broken links will be flagged
• You understand listing fees are non-refundable once a submission enters review
• You grant Gabos AI a license to display your app name, description, icon, and screenshots on the Platform

5. Prohibited Content

The following are prohibited on the Platform:

• Apps that generate CSAM or sexual content involving minors — automatic permanent ban and report to authorities
• Apps designed to deceive, phish, or defraud users
• Malware, spyware, ransomware, or any code that harms devices or data
• Apps that violate applicable laws in the US or the developer's jurisdiction
• Scrapers or tools that violate other platforms' terms of service
• Spam, duplicate submissions, or misleading app descriptions

6. Payments

All payments are processed by Stripe. Listing fees are charged at submission. Featured placement is an additional fee. Memberships are billed annually. We do not store your card details.

Refunds: Listing fees are non-refundable if your app is rejected for violating these terms. If we reject an app for reasons outside your control (e.g., a category we no longer accept), contact us within 30 days for a refund review.

7. Third-Party Apps

Gabos AI links to third-party apps hosted by developers. We are not responsible for the content, privacy practices, or functionality of those apps. Using a third-party app is at your own risk. Always review a developer's own privacy policy before sharing personal data with their app.

8. Intellectual Property

The Gabos AI name, logo, design, and original content are owned by us. You may not use them without written permission. Developers retain ownership of their own app content and agree only to the display license described in Section 4.

9. Moderation and Termination

We reserve the right to remove any app, suspend any account, and refuse service to anyone at any time for any reason. We'll make reasonable efforts to notify you if an app is removed, but are not obligated to do so for violations of these terms. Repeated violations result in permanent bans.

10. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We don't guarantee the Platform will be available 100% of the time, that apps listed will work as advertised, or that the Platform is free from bugs or security vulnerabilities. To the maximum extent permitted by law, we disclaim all warranties.

11. Limitation of Liability

To the maximum extent permitted by law, Gabos AI and its operators will not be liable for indirect, incidental, special, or consequential damages arising from use of the Platform. Our total liability in any dispute will not exceed the fees you paid us in the 12 months prior to the claim.

12. Governing Law

These terms are governed by the laws of the United States. Disputes will be resolved through binding arbitration, except either party may seek injunctive relief in court for IP violations.

13. Changes to These Terms

We may update these terms at any time. Material changes will be emailed to registered users at least 7 days in advance. Continued use of the Platform after changes take effect constitutes acceptance.
